PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Amherst on October 1, 2018 at 7:00 p.m., prevailing time, at the Amherst Municipal Building, 5583 Main Street, Williamsville, New York 14221, to hear all persons interested in following: (1) A proposed amendment of the Bicentennial Comprehensive Plan to the extent that the proposed zoning changes in the proposed local law/ordinance are inconsistent therewith; (2) a proposed Local Law/Ordinance that would Grant Relief of Condition No. 14 imposed on March 19, 2018 by the Town Board in connection with its decision to rezone the property at 2350 Sweet Home Road and 2360 Sweet Home Road (Portion) and (3) to evaluate the potential environmental impacts associated with the proposed action consisting of the above referenced requests to amend the Town of Amherst Bicentennial Comprehensive Plan and grant relief of rezoning condition pursuant to Article 8 of the Environmental Conservation Law of the State of New York and its implementing regulations (collectively known as “State Environmental Quality Review Act” (SEQRA)) and Chapter 104 of the Code of the Town of Amherst.

The Town Board hereby grants relief of the Condition No. 14 for the Project Site, as described in the metes and bounds legal description below, such that the language of Condition No. 14 will be amended to allow: i.) a driveway that will only service a two-unit building to be located along the North Ellicott Creek Road frontage that is depicted as Building No. 14 on the Site Plan prepared by Carmina Wood Morris DPC dated July 19, 2018; and, ii.) a gated emergency access only connection to be installed in order to comply with Appendix D of the NYS Fire Code as depicted on the Site Plan prepared by Carmina Wood Morris DPC dated July 19, 2018, there shall not be any driveway or roadway connection from the project site onto North Ellicott Creek Road.
