DETERMINATION AND FINDINGS PURSUANT TO SECTION 204 OF

EMINENT DOMAIN

PROCEDURE LAW (EDPL)

PROJECT SPONSOR

A Public Hearing was held on June 22, 2018, at the Windermere Boulevard Elementary School, 291 Windermere Boulevard, Amherst, New York 14226. This hearing was held in accordance with the provisions of Article 2 of the New York State Eminent Domain Procedure Law (EDPL) in connection with the acquisition of 159 Niagara Falls Boulevard, Amherst Gateway Park Project. The Public Hearing provided an opportunity for the public to comment on this project and the proposed acquisition.

As provided by EDPL §202, a Notice of Public Hearing was sent by fax and U.S. Mail to the affected property owner, United Refining Company of Pennsylvania. The hearing notice was also published in The Amherst Bee on May 23rd, May 30th, June 6th, June 13th and June 20th, 2018, advising the public that a Public Hearing would be held on June 22, 2018, and that comments would be received concerning the public use, benefit and purposes to be served by the Project and the acquisition of 159 Niagara Falls Boulevard.

The June 22, 2018 hearing provided an opportunity for the public to comment on the proposed project. At this hearing, the Town of Amherst, through Supervisor Brian J. Kulpa, presented information concerning the public use, benefits and purposes to be served by the Project and the proposed acquisition; the reasons for the selection of that location and the general effect of the Project on the residents. The record of the hearing was transcribed. Two people provided verbal comments and one written comment was provided by the property owner, URC. These comments were entered into the record and received at the hearing.

Following the hearing, the Town made available for public inspection, a copy of the hearing transcript, the Notice of Public Hearing, the exhibits introduced at hearing and the copy of Supervisor Kulpa's Powerpoint presentation. Subsequently, an environmental assessment was conducted pursuant to the State Environment Quality Review Act (SEQRA) by the Town, as lead agency, and a Negative Declaration was issued.

Pursuant to EDPL §204(B)(1), and having given due consideration to the complete record of this matter, which includes all documents submitted, the Town of Amherst makes the following Determinations and Findings with respect to the acquisition of 159 Niagara Falls Boulevard, described as follows:

All that tract or parcel of land situate in the Town of Amherst, County of Erie, State of New York, being part of Lot No. 21, Township 12, Range 7 of the Holland Land Company Survey bounded and described as follows:

Beginning at the point of intersection of the easterly line of Niagara Falls Boulevard, 66 feet wide and the northerly line of Kenmore Avenue, 66 feet wide; running thence northerly along the said line of Niagara Falls Boulevard, 104 feet; thence easterly parallel with Kenmore Avenue, 93 feet; thence southerly parallel with Niagara Falls Boulevard, 104 feet to the said northerly line of Kenmore Avenue; and thence westerly along the northerly line of Kenmore Avenue, 93 feet to the point of beginning

THE PUBLIC USE, BENEFIT AND

PURPOSE TO BE SERVED BY

THE PROPOSED PROJECT

(EDPL §204(B)(1))

The Eggertsville area of Amherst is in dire need of re-emergent and re-investment especially in light of the planned expansion of the light rail transit system from the University at Buffalo's South Campus up either Bailey or Niagara Falls Boulevard to the North Campus. This factor above requires re-investment in the area, especially vacant and underutilized lots. The proposed project at Niagara Falls Boulevard and Kenmore Avenue, which involves the parcel sought to be acquired through eminent domain, would greatly impact the area's redevelopment. The project at issue would serve as the Southeast gateway into the Town and would eliminate an eyesore, disgraceful and vacant lot cordoned off by Jersey barriers with appropriate commuter benches with pullover bus lanes which would serve bus passengers along Kenmore Avenue and Niagara falls Boulevard.

Acquisition of the parcel offered the opportunity to take a vacant lot and to turn it into an inter-modal transportation node with a built out pocket park and sitting areas serving commuters and the public. This will provide sufficient space for sheltered bus stops on both Niagara Falls Boulevard and Kenmore Avenue with bus pullovers that do not require pedestrians to dodge traffic (bicycle and vehicular) as well as to protect vehicular traffic from the sudden stops of busses.

THE PROJECT LOCATION AND THE REASONS FOR THE SELECTION OF THAT LOCATION

(EDPL §204(B)(2))

The parcel at issue is located at the corner of Kenmore Avenue and Niagara Falls Boulevard in the Town of Amherst and sits at the Southeast border of the Town which serves as the gateway to the Town of Amherst.

THE GENERAL EFFECT OF THE

PROPOSED PROJECT ON THE

ENVIRONMENT AND THE

RESIDENTS OF THE LOCALITY

(EDPL §204(B)(3))

Construction of the Amherst Gateway Project was reviewed in accordance with 6 NYCRR Part 617 of SEQRA. The proposed project is classified as an unlisted project under SEQRA with the Town acting as lead agency. The general effect of the proposed project on the environment and surrounding locality is as follows:

1.) The action is not expected to cause a substantial adverse change in existing air quality, ground or surface water quality or quantity, or noise levels; a substantial increase in solid waste production; or a substantial increase in the potential for erosion, flooding, leaching or drainage problems.

2.) The action will not result in the removal or destruction of large quantities of vegetation or fauna; or in significant adverse impacts to fish or wildlife species, habitats or other natural resources. The parcel is currently vacant with no vegetation. A Landscape Plan shall be required upon submittal of a site plan application for future development of the site at which stage all landscape requirements of the Zoning Ordinance will be met.

3.) The action is not expected to create any material conflict with the Town Comprehensive Plan. The action will comply with all regulations of the Town Zoning Ordinance before final approval is granted for a future site plan.

4.) The action is not within an area identified by the State as potentially containing significant cultural or archeological resources, nor will it impair the character or quality of important historical resources.

5.) The action will not impair the character or quality of important aesthetic resources or of existing community or neighborhood character. The subject request will allow potential construction of a small mixed-use building with public park area, consistent with surrounding land use in the vicinity and consistent with the Live-Work (LW-1) zoning district.

6.) The proposed action will not cause a major change in the use of either the quantity or type of energy.

7.) The action will not create any hazard to human health.

8.) The action will change the land use on this property, as the currently vacant and unsightly parcel is planned for development. The anticipated development will be consistent with the scale of surrounding land uses and meet all required setbacks to adjacent properties.

9.) The action will increase the number of people using the site over its previous level of use as a vacant parcel. All required infrastructure will be in place to support the increase.

10.) Significant negative traffic impacts are not expected to result from the proposed action. The future development of this property is expected to include a bus stop on both Kenmore Avenue and Niagara Falls Boulevard for the convenience of the public.

11.) Coordinated reviews of the action have been undertaken by Town Departments including the Planning Department and the Attorney’s office. These reviews have not identified any significant environmental issues and indicate that the proposal will not have a significant damaging impact on the environment.

12.) Issues not specifically mentioned above and/or those not specifically reviewed were not raised by Town departments, outside agencies or the public and are not determined to be causing significant negative environmental impacts.

DETERMINATIONS

Upon due consideration of the record and the foregoing findings, it is hereby determined that, unless the Town is able to negotiate a purchase of the parcel at issue, the Town may execute its power of eminent domain to acquire 159 Niagara Falls Boulevard to permit the assembly of that parcel with the Town-owned parcel located at 143 Kenmore Avenue, Amherst, New York to permit the purpose of the Amherst Gateway Park to be achieved. This Determination and Findings is just one step in the acquisition process. The Town prefers to acquire the proposed property through negotiated acquisitions and intends to make offers to the affected property owners prior to commencing eminent domain proceedings. The Town will make all reasonable efforts to contact the affected property owner or the owner's representatives with its offer to purchase the property and will provide the owner with a reasonable opportunity to consider the offers and engage in negotiations before deciding whether to initiate eminent domain proceedings.
