Notice is hereby given that sealed proposals are sought and requested for furnishing tools, merchandise, equipment and/or machinery according to the specifications of a contract with the Town of Amherst, Garbage and Refuse District #1, 5583 Main Street, Williamsville, NY 14221, herein referred to as the "Town," for:

"SUPPLY AND DELIVERY OF 6,000

Sealed proposals will be received by the Town Clerk of the Town of Amherst at her office in the Municipal Building, 5583 Main Street, Williamsville, New York 14221, no later than 2:30 P.M. Local Time, November 19, 2007 and will be considered publicly at such time and place. Plans and specifications can be examined at the TOWN CLERK'S OFFICE, 5583 MAIN STREET, WILLIAMSVILLE, NEW YORK 14221, Monday through Friday, between the hours of 8:00 A.M. and 4:30 P.M. from November 7, 2007 to November 19, 2007.

Each proposal must be accompanied by deposit or a certified check, payable to the Town of Amherst for the sum equal to five percent (5%), such check or bid bond conditioned that if the proposal is accepted, the successful bidder will enter into a contract for supplying of the foregoing mentioned tools, merchandise, equipment, and/or machinery and that he will execute within fifteen (15) days from the date of the acceptance of the proposal a suitable security bond in the amount of the contract conditioned for the faithful and prompt performance and completion of said contract. All deposits, except that of the successful bidder, will be returned.

Upon acceptance of this bid, if the successful bidder fails to enter into a contract pursuant to the requirements of the Town, or fails to give further security prescribed in this notice, within the time limit therein, then the check deposited as aforesaid and the monies standing to the credit of the same, shall be forfeited to the Town of Amherst as liquidated damages or the payment of the bond enforced for the benefit of the Town.

The proposal shall be made upon the form provided therefor and all blank spaces in the form shall be fully filled; numbers shall be stated both in writing and in figures; signatures shall be in longhand, and the completed form shall be without interlineation, alteration or erasure.

No oral, telegraphic or telephonic proposals or modifications will be considered.

Should the bidder find discrepancies or omissions from the specifications, documents or drawings, or should he/she be in doubt as to their meaning, he/she should at once notify Charles W. NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Town Board of the Town of Amherst, Erie County, New York, in the Amherst Municipal Building, 5583 Main Street, Williamsville, New York 14221, on November 19, 2007 at 7:15 p.m., prevailing time, for the purpose of considering the contract with the Village of Williamsville and Hutchinson Hose Company for fire protection and emergency rescue and first aid services to be furnished by the Village of Williamsville and Hutchinson Hose Company and General Ambulance Service to the fire protection district established in said Town and known as District No. 4, Mill Street Fire Protection District, upon the following general terms, to wit:

(a) the fire department shall answer and attend upon all calls in said district;

Each proposal must be accompanied by the deposit of a certified check, payable to the Town of Amherst, for a sum equal to five percent (5%) of the total amount of the Bid, or a bond with sufficient sureties in a penal sum equal to five percent (5%) of such total bid amount, conditioned that if the proposal is accepted, that he will execute within fifteen (15) days from the date of the acceptance of the proposal, a suitable security bond in the amount of the Contract, conditioned for the faithful and prompt performance and completion of the Work specified in the Contract.

All deposits except that of the successful bidder will be returned.

Upon acceptance of his Bid, if the successful bidder fails to enter into a Contract pursuant to the requirements of the Contract Documents, or fails to give the further security prescribed in this Notice, with the same time limited therein, then the check deposited as aforesaid and the monies standing to the credit of the same, shall be forfeited to the Town as liquidated damages, or the payment of the Bond enforced for the benefit of the Town. The Town of Amherst reserves the right to waive informalities in or to reject any and all bids.
