In addition, the facility shall be separated from residential property lines, school property lines, designated historical districts, historical landmarks and historical sites by the minimum distance of 500 feet. The ZBA may modify this condition if the facility is attached to an existing nonresidential structure, or if an easement has been granted or other agreement with all property owners within 500 feet has been reached. In an agricultural district, the WTF shall be located a minimum of 500 feet from any dwelling unit. Any accessory structure shall be located so as to comply with the applicable minimum setback requirements for the property on which it is situated.

Sealed bids for the above mentioned project in the Town of Amherst will be received by the Office of the Supervisor at his office in the Municipal Building, Williamsville, New York, on or before 12:00 P.M. local time on the 25th of April, 2017, at which time they will be publicly opened and read aloud in the Council Chambers, Amherst Municipal Building, 5583 Main Street, Williamsville, New York. Four (4) copies of each Bid are required to be enclosed in an opaque sealed envelope plainly marked on the outside with the name of the Bidder, his address, the name of the Project, and the contract name or number.

Please be advised that a Bidders Conference is scheduled for Friday, April 7, 2017 at 9:30 AM at the Amherst Engineering Department, 1100 North Forest Rd., Williamsville, NY 14221. This will be the only scheduled conference. Bidders interested in submitting bids are strongly encouraged to attend this conference.

Plans and Specifications may be obtained or examined at the office of the Supervisor of the Town of Amherst between the hours of 8:00 A.M. and 4:00 P.M., from March 15, 2017 to April 25, 2017, except Saturdays, Sundays and Holidays. The Town of Amherst reserves the right to extend this bid to other municipalities and qualifying divisions as set forth under NYGML.

A deposit of $100.00 per set is required [two (2) checks of $50.00 each payable to the Town of Amherst]. All Bidders and non-bidders will receive a refund of the entire deposit upon returning plans and specifications in good condition within thirty (30) days of the bid opening.

Proposals shall be made and received upon the following conditions. Each proposal must be accompanied by the deposit of a certified check, payable to the Town of Amherst, for a sum equal to five percentum (5%) of the total amount of the Bid, or a bond with sufficient sureties in a penal sum equal to five percentum (5%) of such total bid amount, conditioned that if the proposal is accepted, that he will execute within fifteen (15) days from the date of the acceptance of the proposal, a suitable security bond in the amount of the Contract, conditioned for the faithful and prompt performance and completion of the Work specified in the Contract.

Upon acceptance of his Bid, if the successful bidder fails to enter into a Contract pursuant to the requirements of the Contract Documents, or fails to give the further security prescribed in this Notice, with the same time limited therein, then the check/bond deposited as aforesaid and the monies standing to the credit of the same, shall be forfeited to the Town as liquidated damages, or the payment of the bond enforced for the benefit of the Town. The Town of Amherst reserves the right to waive informalities in or to reject any and all bids.

TOWN OF AMHERST, NEW YORK

PLEASE TAKE NOTICE that on March 6, 2017, the Town Board of the Town of Amherst, in the County of Erie, New York, adopted a bond resolution entitled: “Bond Resolution of the Town of Amherst, New York, adopted March 6, 2017, authorizing the acquisition of equipment for use by the Highway Department, stating the estimated maximum cost thereof is $611,500, appropriating said amount for such purpose, and authorizing the issuance of bonds in the principal amount of $611,500 to finance said appropriation,” an abstract of which bond resolution concisely stating the purpose and effect thereof, being as follows:

FIRST: AUTHORIZING said Town to acquire equipment for use by the Highway Department, consisting of a street paver at the estimated maximum cost of $216,000, a street sweeper at the estimated maximum cost of $240,000, a hi-lift at the estimated maximum cost of $50,000, three stainless steel dump boxes at the aggregate estimated maximum cost of 96,000 and a vehicle for use by the Highway Department at the estimated maximum cost of $9,500; STATING the estimated maximum cost thereof, including preliminary costs, and costs incidental thereto and the financing thereof, is $611,500; APPROPRIATING said amount for such purpose; and STATING the plan of financing includes the issuance of bonds in the principal amount of $611,500 to finance said appropriation, and the levy and collection of taxes on all the taxable real property in the Town to pay the principal of said bonds and the interest thereon;

SECOND: AUTHORIZING the issuance of bonds in the principal amount of $611,500 pursuant to the Local Finance Law of the State of New York (the “Law”) to finance said appropriation;

THIRD: DETERMINING and STATING the period of probable usefulness applicable to the purpose for which $602,000 of said bonds are authorized to be issued is fifteen (15) years and the period of probable usefulness applicable to the purpose for which $9,500 of said bonds are authorized to be issued is five (5) years; the proceeds of said bonds and any bond anticipation notes issued in anticipation thereof may be applied to reimburse the Town for expenditures made after the effective date of this bond resolution for the purpose for which said bonds are authorized; and the proposed maturity of said bonds will exceed five (5) years;

FOURTH: DETERMINING that said bonds, and any bond anticipation notes issued in anticipation of said bonds, and the renewals of said bond anticipation notes shall be general obligations of the Town; and PLEDGING to their payment the faith and credit of the Town;

SECOND: AUTHORIZING the issuance of bonds in the principal amount of $424,000 pursuant to the Local Finance Law of the State of New York (the “Law”) to finance said appropriation;

Notice is hereby given of the adoption of a Local Law No. 7-2017, entitled “A Local Law Amending Chapter 203 of the Code of the Town of Amherst, the Zoning Ordinance, as Adopted by Local Law 6-2006, Regarding Requirements for Second Access.”

The purpose of this Local Law shall be to amend Section 7-6-7C of Chapter 203 of the Code of the Town of Amherst to remove the requirement that cul-de-sac or dead end streets cannot exceed 800 feet in length without a second point of access. The amendment will make the Code consistent with the International Fire Code which establishes thresholds for required second access based on the number of residential units or square footage of commercial space.
