PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Amherst on September 8, 2014 at 7:00 p.m., prevailing time, at the Amherst Municipal Building, 5583 Main Street, Williamsville, New York 14221, to hear all persons interested in following: (1) A proposed amendment of the Bicentennial Comprehensive Plan to the extent that the proposed zoning changes in the proposed local law/ordinance are inconsistent therewith; (2) a proposed Local Law/Ordinance that would amend the zoning classification of the property described herein as depicted on the Official Zoning Map and (3) to evaluate the potential environmental impacts associated with the proposed action consisting of the above referenced requests to amend the Town of Amherst Bicentennial Comprehensive Plan and the Official Zoning Map pursuant to Article 8 of the Environmental Conservation Law of the State of New York and its implementing regulations (collectively know as “State Environmental Quality Review Act” (SEQRA)) and Chapter 104 of the Code of the Town of Amherst.

The Town Board will consider a request to rezone 62.95± acres of land by the Town of Amherst; properties located as follows:

Zoning Districts

R-2 – Residential District - Two

R-3 – Residential District – Three

RC – Recreation Conservation District

CF – Community Facilities District

Amherst Central School District:

In compliance with the U.S. Environmental Protection Agency (EPA) Asbestos Hazard Emergency Response Act (AHERA), each of our school buildings was inspected in the fall of 1988 for asbestos containing building materials. In addition to the initial inspections the EPA requires the District to perform reinspections of all asbestos-containing materials every three years and visual checks every six months. These are performed by an accredited asbestos inspector and management planner who makes recommendations to the District on how to best manage the existing asbestos.

The reinspections and visual surveillance results can be found in the Amherst Central School District’s Asbestos Management Plan. A master copy of the District’s Plan is located at the High School in the office of Facilities Management. The plan may be reviewed during normal business hours by appointment only.

The last triennial inspection was completed in July 2013, and the results were sent to the State Education Department in Albany. The next triennial inspection is scheduled for July 2016.

Since the last notification there were several asbestos abatement projects in the District. Each abatement project was completed by a certified and licensed asbestos removal contractor. Each abatement project was observed, monitored and tested by a certified and licensed air monitoring firm hired directly by the District. Samples collected were sent to an independent accredited asbestos testing laboratory for analysis. The abatement projects were directly related to the Capital Construction Project currently ongoing at each building. Quantities of asbestos removed and properly disposed of will be available in the management plan at the conclusion of the construction project.

The remaining asbestos containing building material (ACBM) in each building consists of 9” x 9” vinyl asbestos floor tiles (VAT), thermal system insulation (TSI), and transite panels. The VAT that remains is located in most of the classrooms. The TSI remaining can be found in the crawl spaces and pipe chases. The transite panels are in the middle school auditorium, high school attic and south gymnasium. LOCAL LAW/ORDINANCE

PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Amherst on September 8, 2014 at 7:00 p.m., prevailing time, at the Amherst Municipal Building, 5583 Main Street, Williamsville, New York 14221, to hear all persons interested in following: (1) A proposed amendment of the Bicentennial Comprehensive Plan to the extent that the proposed zoning changes in the proposed local law/ordinance are inconsistent therewith; (2) a proposed Local Law/Ordinance that would amend the zoning classification of the property described herein as depicted on the Official Zoning Map from Residential District Three (R-3) to Multi-Family Residential District Five (MFR-5) and (3) to evaluate the potential environmental impacts associated with the proposed action consisting of the above referenced requests to amend the Town of Amherst Bicentennial Comprehensive Plan and the Official Zoning Map pursuant to Article 8 of the Environmental Conservation Law of the State of New York and its implementing regulations (collectively know as “State Environmental Quality Review Act” (SEQRA)) and Chapter 104 of the Code of the Town of Amherst.

ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Amherst, County of Erie, State of New York, being part of Lot 66, Township 12, Range 7 of the Holland Land Company’s survey, more particularly described as follows:

This notice is provided pursuant to New York State Municipal Home Rule §20, Town Law §§ 130, 264 and 272-a, as well as §8-2 of the Town of Amherst Zoning Ordinance and Chapter 28 of the Code of the Town of Amherst.
