NOTICE OF SOLICITATION OF GENERAL CONTRACTORS FOR THE WILLIAMSVILLE MILL COMPLEX: STABILIZATION OF THE MILL BUILDING (PHASE 2), 56 EAST SPRING STREET, WILLIAMSVILLE, NY PROPERTY OF THE VILLAGE OF WILLIAMSVILLE, 5565 MAIN STREET, WILLIAMSVILLE, NEW YORK

Sealed bids for the Williamsville Mill Complex; Mill Building Stabilization (Phase 2) will be received until 2:00 pm, Thursday, August 14, 2014 at the offices of The Village of Williamsville (Attn: Lynda Juul), where they will be opened and read. Each bid must be prepared and submitted in accordance with the Bidding and Contract Documents and must be accompanied by references of similar projects and a bid security in the form of a Certified Check, Bid Bond or Bank Check in the amount of 10 percent of the bid amount. Bidders must have a minimum of 5 years successful experience in completion of similar projects for State, National or locally registered landmarks.

The successful bidder will be required to furnish a Performance Bond and a Payment Bond each for 100% of the amount of the Contract. The completion date for this project is May 28th, 2015.

Funding for this project comes in part through an Environmental Protection Fund grant administered by the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) through Title 9 of the Environmental Protection Act of 1993. Under Article 15A, Executive Law, the State of New York is committed to providing Minority and Women Owned Business (MWBE) equal opportunity to participate in government contracts. The following goals have been set for this project: 8% Minority and 7% Women Owned businesses. The successful bidder may be required to furnish reports showing the participation of various business enterprises of subcontractors and suppliers on the contract. All bidders are subject to the terms of the NYS Master Contract for Grants – Standard Terms and Conditions, which can be found online at http://grantsreform.ny.gov\.

Effective Thursday, July 24, 2014, Bid Documents may be obtained at Flynn Battaglia Architects, 617 Main Street, Suite 401, Buffalo, New York 14203. Each request must be accompanied by a certified check in the amount of $50.00 (non-refundable) for each set of drawings and specifications. Cash or personal Checks will not be accepted.

Each proposal must be accompanied by the deposit of a certified check, payable to the Town of Amherst, for a sum equal to five percentum (5%) of the total amount of the Bid, or a bond with sufficient sureties in a penal sum equal to five percentum (5%) of such total bid amount, conditioned that if the proposal is accepted, that he will execute within fifteen (15) days from the date of the acceptance of the proposal, a suitable security bond in the amount of the Contract, conditioned for the faithful and prompt performance and completion of the Work specified in the Contract.

Upon acceptance of his Bid, if the successful bidder fails to enter into a Contract pursuant to the requirements of the Contract Documents, or fails to give the further security prescribed in this Notice, with the same time limited therein, then the check/bond deposited as aforesaid and the monies standing to the credit of the same, shall be forfeited to the Town as liquidated damages, or the payment of the bond enforced for the benefit of the Town. The Town of Amherst reserves the right to waive informalities in or to reject any and all bids.

TOWN OF AMHERST, NEW YORK

PLEASE TAKE NOTICE that on July 21, 2014, the Town Board of the Town of Amherst, in the County of Erie, New York, adopted a bond resolution entitled:

“Bond Resolution of the Town of Amherst, New York, adopted July 21, 2014, authorizing the replacement of traffic signal controls at Maple Road and Maplemere Road, stating the estimated maximum cost thereof is $75,000, appropriating said amount for such purpose, and authorizing the issuance of bonds in the principal amount of $75,000 to finance said appropriation,” an abstract of which bond resolution concisely stating the purpose and effect thereof, being as follows:

FIRST: AUTHORIZING said Town to replace traffic signal controls at Maple Road and Maplemere Road (signal #24), including study and design, as described in the map, plan and report dated July 2014, prepared by the Town Engineering Department; STATING the estimated maximum cost thereof, including preliminary costs, and costs incidental thereto and the financing thereof, is $75,000; APPROPRIATING said amount for such purpose; and STATING the plan of financing includes the issuance of $75,000 serial bonds of the Town to finance said appropriation, and the levy of a tax upon all the taxable real property within the Town to pay the principal of said bonds and interest thereon;

SECOND: AUTHORIZING the issuance of $75,000 serial bonds of the Town pursuant to the Local Finance Law of the State of New York (the “Law”) to finance said appropriation;

THIRD: DETERMINING and STATING the period of probable usefulness applicable to the purpose for which said serial bonds are authorized to be issued is twenty (20) years; the proceeds of said bonds and any bond anticipation notes issued in anticipation thereof may be applied to reimburse the Town for expenditures made after the effective date of this bond resolution for the purpose for which said bonds are authorized; and the proposed maturity of said $75,000 serial bonds will exceed five (5) years;

FOURTH: DETERMINING that said bonds, and any bond anticipation notes issued in anticipation of said bonds, and the renewals of said bond anticipation notes shall be general obligations of the Town; and PLEDGING to their payment the faith and credit of the Town;

FIFTH: DELEGATING to the Supervisor the powers and duties as to the issuance of said bonds, and any bond anticipation notes issued in anticipation of said bonds, or the renewals thereof; and

SIXTH: DETERMINING that the bond resolution is subject to a permissive referendum.

OF LOCAL LAW

Notice is hereby given of the adoption of a Local Law No. 31-2014, “A Local Law Amending Chapter 32, Minority and Women Owned Business Utilization Commitment, of the Code of the Town of Amherst, With Respect To Updating.” This Local Law was adopted at the Town Board meeting held on July 21, 2014.

This Local Law amends Chapter 32 of the Code of the Town of Amherst with respect to general updates.

Copies of the Local Law are available for inspection at the Office of the Amherst Town Clerk, 5583 Main Street, Williamsville, New York 14221, during regular business hours. This notice is provided pursuant to Town Law §§130 and 133 and Chapter 28 of the Code of the Town of Amherst.
