Sealed bids in triplicate for the Williamsville Central School District Mill Middle Emergency Exit Project will be received until 3:30 PM, local time, on April 12, 2011, at the office of Purchasing Agent c/o Ms. Linda Braun at the Williamsville Central School District Main Administration Office 105 Casey Road, East Amherst, New York 14051 and then, at that time place and time, publicly opened and read aloud.

1. The project includes various exterior and interior renovations at the Mill Middle School in Williamsville, New York.

2. Bids will be (2) two prime contracts: Sitework and Electrical.

3. A pre-bid meeting will be held at 3:00 PM, local time, on April 6, 2011 at the Mill Middle School, Williamsville, New York. A review and walk-through of the project will be conducted and pertinent questions will be received.

4. Qualification of Bidders

A. The Owner may make such investigation, as he deems necessary to determine the responsibility of any bidder to perform the work.

B. Bidders shall furnish to the Owner the information and data required, including complete financial data, within the time, in the form and in the manner required by the Owner.

C. The Owner reserves the right to reject any bid, and to disqualify the bid, if the evidence submitted or investigation of any such bidder fails to satisfy the Owner that such bidder is responsible, or is able or qualified to carry out obligations of the Contract or to complete the work as contemplated therein.

5. The Owner reserves the right to waive any informality in or to reject any or all bids.

6. All bidders shall submit with their quotations, acceptable bid security in the amount of five (5) percent of their bid.

7. Successful bidders shall provide Owner with performance and payment bonds in the prescribed form and with an acceptable security, in accordance with the Supplementary Instructions to Bidders.

DECISION AND ORDER

In the Matter of the Amendments of the

Final Freshwater Wetlands Maps for

ERIE COUNTY

WHEREAS:

I. Subsequent to the promulgation of the final Freshwater Wetlands Maps for Erie County dated September 10, 1986, Department of Environmental Conservation (DEC) Region 9 Staff found an inaccuracy on Map 3 of 31.

II. Environmental Conservation Law (ECL) § 24-0301(6) authorizes the Commissioner of DEC to amend the maps to reflect changes needed to correct errors or changes to the wetland.

III. At the time Staff proposed an amendment to the map, notice was provided as required by ECL §§ 24-0301(5) and 24-0301(6) and NYCRR § 664.4 and §664.7. A thirty-day public comment period was provided for the proposed amendment and a legislative public hearing was not held. A public comment period was provided through October 3, 2008.

IV. DEC Staff reviewed the public comments and now recommends the final maps for Erie County be amended to add Wetland TE-38, a Class II wetland, to Map 3 of 31.

V. Upon review of DEC Region 9 staff’s findings and recommendations, I am satisfied that Staff’s actions are appropriate. I conclude that Staff’s recommendations are consistent with the requirements of the Freshwater Wetlands Act and are supported by the record.

NOW THEREFORE, in accordance with the authority vested in me under

ECL§ 24-0301(6), I hereby ORDER the following to become effective on November 17, 2010:

1. that the final maps and classification sheets for Erie County shall be amended as recommended in Paragraph IV;

2. that a copy of the final maps for Erie County, as amended, or the relevant portions thereof, shall be filed in the office of the clerk of each local government in Erie County that is affected by the foregoing amendments;

3. that the classifications shown on the classification sheet attached to the affected quadrangle be and hereby are established; and

4. that this Decision and Order shall be filed, mailed and published in accordance
