PUBLIC HEARING

Notice is herewith given of public hearing, complying with New York State Town Law (§272a,6-b), and 6 NYCRR 617 (SEQR) provisions, to be held by the Town Board of the Town of Amherst, New York, at the Municipal Building, 5583 Main Street, Williamsville, NY, on Monday, October 30, 2017, at 7:00 p.m. to consider comments on the proposed amendments to the Town’s Bicentennial Comprehensive Plan and a Draft Generic Environmental Impact Statement (DGEIS).

The subject of the Hearing involves adoption of amendments to the Town of Amherst Bicentennial Comprehensive Plan. The proposed Comprehensive Plan amendments are the result of the Imagine Amherst project which aims to improve commercial and mixed use centers in Amherst by updating the Town’s Comprehensive Plan so that these centers fit better with surrounding areas and produce development the Town and residents desire. The amendments are proposed primarily to Chapters 3 and 10, Land Use and Development and Focal Planning Areas. More specifically, changes are proposed to Sections 3.3.2 (Commercial and Industrial Uses) and 3.3.3 (Mixed Use Patterns). New categories have been created for these centers in order to distinguish them by their scale, location, and neighborhood context, and to determine how each should develop in the future – these are shown in the a new Figure 6-A. Corresponding modifications were proposed to Figure 6 and to the text in Chapters 3 & 10. Other editorial or minor changes are also proposed throughout the text.

The proposed amendments are available for public review online at www.amherst.ny.us, and on the project website at www.imageinamherst.com. The Amendments are also available for viewing in the office of the Town Clerk and in the Planning Department Office.

All persons desiring to comment on the proposed Comprehensive Plan amendments are asked to appear at the above time and place.

ADOPTION OF PROPOSED

LOCAL LAW/ORDINANCE

PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Amherst on October 30, 2017 at 7:00 p.m., prevailing time, at the Amherst Municipal Building, 5583 Main Street, Williamsville, New York 14221, to hear all persons interested in following: (1) A proposed amendment of the Bicentennial Comprehensive Plan to the extent that the proposed zoning changes in the proposed local law/ordinance are inconsistent therewith; (2) a proposed Local Law/Ordinance that would Amend Land Use Classification of 2660 Millersport Highway from NB (Neighborhood Business District) to CS (Commercial Service District) and (3) to evaluate the potential environmental impacts associated with the proposed action consisting of the above referenced requests to amend the Town of Amherst and Chapter 104 of the Code of the Town of Amherst.

The Town Board hereby amends its zoning map which is incorporated by reference in the Town zoning code by amending from NB (Neighborhood Business District) to CS (Commercial Service District), the zoning of 2660 Millersport Highway, subject to any conditions imposed by the authorizing resolution; legally described as follows:

ALL THAT TRACT OR PARCEL OF LAND, situated in the Town of Amherst, County of Erie and State of New York, being part of Lot No. 63, Township 12, Range 7 of the Holland Land Company’s Survey, bounded and described as follows:

BEGINNING at a point in the westerly line of Millersport Highway, said point being 128.55 feet southwesterly of the northeasterly corner of lands conveyed to Edward E. Cooke and Gertrude F. Cooke, his wife by deed recorded in the Erie County Clerk’s Office on July 28, 1944, Liber 3574 of Deeds at Page 240; thence southwesterly along the westerly line of said Millersport Highway 128.55 feet to a point; thence westerly on a line parallel to the northerly line of lands conveyed by the aforesaid deed 369.35 feet to a point; thence northeasterly on a straight line 109.50 feet to a point; said point being 405.95 feet westerly from the point of beginning; thence easterly along a line parallel to the northerly line of lands conveyed to the grantors herein by the aforesaid deed 405.95 feet to the point or place of beginning; containing about 0.89 acres of land be the same more or less.

Copies of the proposed Local Law/Ordinance are available for inspection at the Office of the Amherst Town Clerk, 5583 Main Street, Williamsville, New York 14221, during regular business hours. This notice is provided pursuant to New York State Municipal Home Rule §20, Town Law §§ 130, 264 and 272-a, as well as §8-2 of the Town of Amherst Zoning Ordinance and Chapter 28 of the Code of the Town of Amherst.

All persons in favor or opposed to the proposed amendment of the Town of Amherst Bicentennial Comprehensive Plan, the Local Law/Ordinance described herein, or the environmental review of the actions pursuant to Article 8 of the Environmental Conservation Law of the State of New York and its implementing regulations (collectively know as “State Environmental Quality Review Act” (SEQRA)) and Chapter 104 of the Code of the Town of Amherst, are asked to appear at the above time and place.

VILLAGE OF WILLIAMSVILLE

NOTICE IS HEREBY GIVEN that a bond resolution, a summary of which is published herewith, has been adopted by the Village Board of Trustees of the Village of Williamsville, County of Erie (the “Vil- lage”), on September 11, 2017 and the validity of the obligations authorized by such resolution may be hereafter contested only if:

1. (a) such obligations were authorized for an object or purpose for which the Village is not authorized to expend money, or

(b) the provisions of the law which should have been complied with as of the date of publication of this notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within 20 days after the date of such publication of this notice; or

2. such obligations were authorized in violation of the provisions of the Constitution of New York.

SUMMARY OF

BOND RESOLUTION

The following is a summary of a bond resolution adopted by the Village Board of Trustees of the Village of Williamsville on September 11, 2017. The proceeds from the sale of the obligations authorized in such bond resolution shall be used for the acquisition of various equipment for use by the Village, including any preliminary costs and necessary equipment, apparatus, warranties and other such costs incidental thereto and in connection with the financing thereof (collectively, the “Purpose”), at an estimated maximum amount of $360,000 such amount to be financed by the issuance and sale of a serial bond or bonds and a bond anticipation note or notes in anticipation of the issuance and sale of such serial bonds, in an aggregate principal amount not to exceed $360,000 such amount to be offset by any trade-in amounts (estimated to be $10,000) and any federal, state, county and/or local funds received. Such bond resolution was adopted subject to permissive referendum, and such permissive referendum period has elapsed without the filing of a petition. The period of probable usefulness for such purpose is 15 years. A copy of the resolution summarized herein is available for public inspection during normal business hours at the Office of the Village Clerk, located in the Village Hall, Village of Williamsville, 5565 Main Street, Williamsville, New York.

NOTICE is hereby given of a public hearing to be held before the Zoning Board of Appeals of the Town of Amherst, Erie County, New York, at the Amherst Municipal Building, 5583 Main Street in the Village of Williamsville, Erie County, New York, on Tuesday, October 24, 2017, at 6:30 o’clock P.M. to hear all persons interested in an appeal taken by East Coast Ink, c/o Jim LeAir, 1414 Millersport Highway, Suite 1414, Williamsville, NY 14221 requesting a renewal of a temporary use permit to the Town of Amherst Zoning Ordinance for a tattoo parlor at 1400 – 1430 Millersport Highway (suite 1414).

The foregoing notice is given pursuant to Section 8-2, Sub. 8-2-3B of the Zoning Ordinance of the Town of Amherst, New York, and pursuant to order of the Zoning Board of Appeals of the Town of Amherst, New York.
